The following are the terms and conditions (these "Terms and Conditions") of participating in the MyCreditCardCash.com Member Program (the "Program" or "Affiliate Program"). "Member" refers to you. We may also refer to you as "you" or "your" in the possessive. "Site" refers to us. "Site" means a World Wide Web site and, depending on the context, refers either to the MyCreditCardCash.com site, located at the URL www.MyCreditCardCash.com, or to any site that you will link to our site including but not limited to NewCreditApplications.com. MyCreditCardCash.com reserves the right to amend these Terms and Conditions as needed from time to time. You agree that any such amendment will apply to you, the Member. By accepting commissions where applicable and/or continuing to use MyCreditCardCash.com products and services, Member agrees to these amendments.

"we"/"our" - MyCreditCardCash.com, NewCreditApplications.com and all things associated with these web sites.
"financial partners" - Our financial partners that furnish a product or service to us for use with the web site you are given when you become a member.
"you"/"member" - The person or legal entity participating in the MyCreditCardCash.com program.
"your site"/"membership" - The web address that we have leased to you to market. This consists of a sub domain of one of the domains we own or a private domain we've leased to you. Your membership also includes access to our users area and tracking system.
"qualified lead" - A completion of a credit card application. In order to receive credit, it depends on the particular offer. Approval for the credit card may or may not be required depending on the offer. "active member" - A member who has his account open, being either a paying customer, or a customer who has completed the minimum amount of card leads to not be billed any longer. You must not have cancelled the membership with MyCreditCardCash.com or had his/her account closed due to violation of our terms and agreement.

Sending any e-mail on any subject to anyone or any organization that has not requested this information, without specifically requesting it directly or by giving his or her permission for you to send them information, is prohibited. We do not tolerate members sending junk e-mail. Because of the nature of our service, you may be tempted to profit by sending mass e-mails. Be advised: You may not send unsolicited e-mail. E-mails are much more effective when sent to groups in an e-mail newsletter or other participating in a group program.
Sending junk e-mail advertising of any kind from our website(s) is cause for immediate and permanent termination of your membership, including any and all commissions due to be paid to you, where applicable.
We accept and log spamming complaints at our home office. The accumulation of 5 or more complaints to any single e-mail account is grounds for termination.
If you violate this policy and it causes damage or loss to our servers, or causes one (or more) of our web sites to be interrupted from normal service, you will be held liable for actual damages and/or any indirect, incidental, special or consequential damages, such as loss of business.

Your participation in the Program is based on good faith, to wit: that you represent the offers, as delivered to you, correctly. We may terminate your membership in the Program at any time if we determine (in our sole discretion) that your representation and sites whereon you are advertising are unsuitable for the Program. Unsuitable sites include those that:

• Promote violence or the profane;

• Violate intellectual property rights.

If we terminate your membership in the Program for any reason, you are welcome contest the termination. You are prohibited to reapply to the Program at any time. You should also note that if we agree to reactivate your membership and your site is thereafter determined (in our sole discretion) to be unsuitable for the Program, we may terminate this agreement implicit in these Terms and Conditions.

By joining, you agree to pay a $1.97 activation fee which covers the cost of your 14 day trial of MyCreditCardCash.com. After the 14-day trial, you also agree that you will be billed $37.95 a month until you decide to cancel, your you accumulate 2 credit card sign ups. You may also cancel during the 14-day period and you will not be billed $37.95

Membership fees cover hosting and maintenance of your website in addition to leasing of domain name, customer support, and access to our users area.

Your membership can cancelled at anytime during the free trial period or anytime thereafter by calling 800-611-3347 or by emailing support@MyCreditCardCash.com and requesting to be cancelled. All cancellations take place within 24 hours.

Customers who join as Members through this Program will be deemed customers of MyCreditCardCash.com and its parent organizations, affiliates, partners or associates. Accordingly, all MyCreditCardCash.com rules, policies, operating procedures, customer service, and sales will apply to those customers. We may change our policies and operating procedures at any time. Product prices and availability may vary from time to time. We will use commercially reasonable efforts to present accurate information, but we cannot guarantee the availability or price of any particular product. MyCreditCardCash.com issues payment once per month, at the end of the month. In order to receive payment, you must be an "active member" and must have been a member for at least 14 days.

Payment is issued via paypal or check. It is the member's responsibility to configure their profile at all times to reflect the correct payment address/payment information. If more than 2 attempts have been made to pay you and your account is not configured, your account will be suspended and or closed.

We grant you a nonexclusive, revocable license to use the text or images that we provided to you, that are relevant to your participation in the Program. The limited license is given solely for the purpose of marketing your site. You may not modify the graphic image or text provided, or any other of our images, in any way. We reserve all of our rights in any and all graphic images and texts, any other images, our trade names and trademarks, and all other intellectual property rights that are expressly and/or impliedly granted in this paragraph. We may revoke your limited license at any time by giving you written or email notice.

You are solely responsible for the development, marketing, promotion, of any/all member sites. The success of your marketing efforts, as reflected in the number of credit card leads and commissions earned, may vary based on current marketing conditions. Any creative materials we provide for marketing and the Program in general carry no guaranteed or successful or profitable results. For example, you will be solely responsible for:

• The accuracy and appropriateness of materials posted on Member sites (including, among other things, all product-related materials);
• Ensuring that materials posted on member sites do not violate or infringe upon the rights of any third party (including, for example, copyrights, trademarks, privacy, or other personal or proprietary rights) or violate any city, county, state or federal law;
• Ensuring that materials posted on Member sites are not libellous or otherwise illegal;
• Ensuring that Member sites accurately and adequately disclose, either through a privacy policy or otherwise, how you collect, use, store, and disclose data collected from visitors, including, where applicable, how third parties (including advertisers) may serve content and/or advertisements and collect information directly from visitors and may place or recognize cookies on visitors' browsers. We disclaim all liability for these matters. Further, you will indemnify and hold us harmless from all claims, judgment, demands, damages, and expenses (including, without limitation, attorneys' fees) relating to the development, operation, maintenance, and contents of your marketing efforts, relative to your participation in the Program.

Offline promotion is expressly forbidden except for where written permission is given to you by MyCreditCardCash.com. To request permission you must send MyCreditCardCash.com an email to support@MyCreditCardCash.com with your account information and a detailed description how you will market credit cards offline. Your submission of a request for offline promotion approval does not imply approval, you must be explicity approved by MyCreditCardCash.com in writing before starting any offline marketing. If your plan to market offline is approved you must adhere to the details of the approved plan. If you wish to deviate from the approved offline marketing plan you must restart the approval process and request that the deviation is approved before deviating from the approved plan. Failure to abide by this term is subject to immediate and permanent termination of your membership, including any and all commissions due to be paid to you, where applicable. Furthermore you may be held financially and legally responsible for any and all damages incurred.

Incentivized traffic is expressly forbidden under any and all circumstances. Also, you may not offer potential customers an incentive in any form to complete an application. This includes cash, prizes or any other type of benefit for signing up for the card. Failure to abide by this term is cause for immediate and permanent termination of your membership, including any and all commissions due to be paid to you, where applicable. Furthermore you may be held financially and legally responsible for any and all damages incurred.

This is strictly prohibited. You may not enter in another person's personal information in order to try to get them approved for a credit card. Not only may this be deemed illegal, it will also result in permanent account closure and forefeiture of all accumulated funds. If you want someone to sign up for a credit card, they must sign up and enter the information on their own.

You agree to pay all applicable taxes in your area of jurisdiction. Once your commission total amount exceeds $600.00 for any given year, you must provide us with a 1099-MISC form which must be completed and returned to us. If you do not complete the form and return it to us, you will not receive further payments from us.

The reports we furnish to you regarding your qualified leads are based entirely off of the reporting of our financial partners. The numbers we receive from our financial partners are the final say in all reporting and you agree that you understand that while we make every effort to report accurate data, certain circumstances my cause reporting to not be entirely accurate (i.e. financial partners have problem with reporting, which is passed on to you).

You agree and understand that we are not responsible for any financial losses incurred while spending money promoting your web site. Even if you follow our marketing advice/ideas and it is unsuccessful, we are not liable. We are not responsible for any financial losses for any reason related to using our service. You agree that you use this service at your own risk.

1. Member may not use his or her knowledge, or association with other Members to compete against MyCreditCardCash.com. Also, Members may not enter into an agreement with any company that is connected to, associated with credit card affiliate industries. However, Members may partner with companies for the purpose of marketing or selling products from their Member sites. This would include, but not be limited to, text link brokering sites, pay per click advertising, traffic promotion sites, etc...
2. Member agrees that he or she is an independent contractor, and not an employee, agent, partner, legal representative, or franchisee of MyCreditCardCash.com. Member further agrees not to incur any debt, expense, and obligation on behalf of, for, or in the name of MyCreditCardCash.com.
3. Applications for Member status are subject to approval by MyCreditCardCash.com.
4. Member must be of legal age in his/her state.
5. MyCreditCardCash.com is not responsible for acts by third parties, or other events outside our reasonable control, which may temporarily disrupt or diminish Member’s service.
6. Member shall follow MyCreditCardCash.com advertising guidelines and agrees not to misrepresent MyCreditCardCash.com’s products or services.
7. MyCreditCardCash.com shall not be held liable for any indirect, incidental, special or consequential damages or any loss of revenue or profits arising under or with respect to these terms and conditions or the Program, irrespective if MyCreditCardCash.com has been advised of the possibility of such damages. MyCreditCardCash.com aggregate liability arising under or with respect to these Terms and Conditions and/or the Program shall in no event exceed the total commissions paid or payable by MyCreditCardCash.com under this agreement.
8. MyCreditCardCash.com makes no warranties, expressed or implied, with regard to the Program except as outlined in there Terms and Conditions.
9. In the event that a provision in these Terms and Conditions is held to be invalid or unenforceable, such provision shall be reformed only to the extent necessary to make it enforceable, and the balance of these Terms and Conditions will remain in full force and effect.
